Selected theme describes and analyzes selected questions of
historical development of legal institute called public good,
rediscovered in Czech legal background, mainly to the civil law
and land law and in the close relationship to the land registry
and related administrative proceedings.
Center of theme is historical – legal analysis of public good
in the light of all civil codes which have performed on
territory of present Czech republic since 1811 to present day
(including the new Act No. 89/2012 Coll., Civil Code, effective
from January 1st, 2014).
The theme summarizes claiming of the public good institute in
the compensation for Czech legal background than the new Civil
Code will come into force. Presented thesis has been developed
mainly by using a compilation, comparison and analysis with the
help of historical data such as legal literature and conference
papers from professional journals published by renowned jurists
of their days (Randa, Hoetzel, Tilsch, Pražák and others),
former and present legislation and relevant judicial decesions.
