Anotace

Diplomová práce má si klade za úkol prozkoumat právní aspekty konceptu tzv. kybernetického odstrašování a zjistit, jak se tento koncept projevuje ve vybraných právních předpisech České republiky. Autorka rozebere teorii odstrašování a pokusí se na základě teorii určit, zda a jak lze dosáhnout účinného odstrašování v kybernetickém prostoru. The thesis aims to explore the possibilities of cyber deterrence from the legal perspective and apply the knowledge to the case study of the Czech Republic. The thesis aims to explore the possibilities of cyber deterrence from the legal perspective and apply the knowledge to the case study of the Czech Republic. The author will discuss the deterrence theory and how effective deterrence in cyberspace can be achieved (if ever). Concerning the Czech Republic, the analysis of cyber deterrence will focus on Act no. 181/2014 Sb., on Cyber Security and Act no. 289/2005 Sb., on Military Intelligence. Additionally, the respective national cyber security and defence strategies will be analysed. The thesis aims to answer whether the Czech national legislation contributes to the overall deterrence posture vis-á-vis various malicious actors.
